TERMS AND CONDITIONS
The term "Agency" used in these Terms & Conditions refers to Bluesky Holiday LLP, and the website www.blueskyholiday.in is owned and operated by
Bluesky Holiday LLP.
1. GENERAL INFORMATION
All information provided on this website is based on details available at the time of publication. The Agency reserves the right to amend any information before or after booking due to unforeseen circumstances. Any significant changes
will be communicated at the time of booking or during the tour by our Tour Manager or local representative.
The Agency is a travel and holiday organizer and does not control or operate airlines, shipping agencies, hotels, transport providers, or other service providers. We ensure quality selection but cannot be held responsible for mechanical
failures, service disruptions, or any loss, injury, or damage caused by third-party service providers.
2. CONTRACT & PAYMENT TERMS
A contract is formed between the Agency and the Client only upon receipt of the initial deposit as specified for each tour package. Full payment must be received as per the payment
schedule. Failure to make payment on time may result in cancellation, forfeiture of deposit, and applicable cancellation charges. The Agency reserves the right to terminate the contract before tour commencement without assigning any
reason, in which case only the deposit will be refunded without interest.
3. CHANGES & CANCELLATION POLICY
- The Agency reserves the right to amend, alter, vary, or withdraw any tour, excursion, or service if necessary, without liability for damages, additional expenses, or consequential losses.
- The Agency is not responsible for losses due to cancellation of flights, trains, or bus tickets booked by Clients independently or through the Agency.
- Any amendments or cancellations by the Client must be communicated in writing. Advance payments are non-refundable, and the following charges will apply:
- 30 days or more before departure: Non-refundable advance amount.
- 30 to 15 days before departure: 50% of the total tour cost.
- 14 to 7 days before departure: 75% of the total tour cost.
- Less than 7 days before departure: 100% of the total tour cost.
4. HEALTH & SAFETY
The Agency is not liable for:
- Death, personal injury, sickness, accident, loss, delay, or damage caused by third-party service providers.
- Acts of negligence by independent contractors providing accommodation, transport, or services.
- Loss or damage to baggage or personal belongings.
The liability of the Agency for any claims arising from the tour shall not exceed the total amount paid by the Client.
5. INSURANCE
Tour packages do not include travel insurance. Clients are advised to obtain their own insurance policies. The Agency is not responsible for any claims related to insurance.
6. FORCE MAJEURE
The Agency shall not be liable for disruptions caused by force majeure events, including but not limited to:
- Natural disasters (earthquakes, floods, extreme weather conditions)
- Political events (wars, riots, government restrictions)
- Strikes, pandemics, or any other circumstances beyond our control
Any additional expenses due to force majeure shall be borne by the Client.
7. MEALS & ACCOMMODATION
- Pre-set menus are provided for meals as per the itinerary. Special dietary requests cannot be guaranteed.
- No refunds will be provided for missed meals due to late arrival or personal delays.
- Hotels listed in itineraries are subject to change due to unavoidable circumstances. In such cases, alternative accommodations of similar standards will be arranged.
- The Agency is not responsible for loss of property or life at hotels. Clients are liable for any damages caused to hotel rooms during their stay.
8. TRANSPORT & SEATING
- Vehicles provided include luxury coaches, tempo travelers, and cars based on group size and availability.
- Seat allocation is on a first-come, first-served basis and remains fixed throughout the tour.
- The Agency is not responsible for theft, loss, or damage to personal belongings left in vehicles.
- Clients must adhere to tour schedules. Missed sightseeing due to Client delays will not be refunded.
9. ITINERARY CHANGES
For operational reasons, the Agency may:
- Reverse or modify tour itineraries.
- Substitute excursions with similar alternatives.
- Make adjustments to ensure passenger comfort and safety.
No refunds will be provided for changes made in the itinerary.
10. TRANSFER & POSTPONEMENT
- A transfer from one tour to another will be treated as a cancellation and rebooking, attracting applicable charges.
- Clients can request a tour postponement/preponement at least 7 days prior to departure by paying an additional fee of INR 3,000 per booking.
11. COMPLAINTS & CLAIMS
- Any service-related complaints must be reported to the Tour Manager or Independent Contractor immediately for resolution.
- Written complaints must be submitted to the Agency within 7 days of tour completion. Claims submitted after this period will not be entertained.
12. LEGAL JURISDICTION
Any disputes arising from these Terms & Conditions shall be subject to the jurisdiction of the courts in Manali, India.
By booking a tour with Bluesky Holiday LLP, the Client acknowledges and agrees to the above Terms & Conditions.
